Terms of Service

1. Acceptance of Terms

By accessing or using ValiFit ("the Service"), operated by ValiFit, Inc. ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ValiFit provides property intelligence reports, personalized scoring, and tools to connect home buyers with real estate professionals. Our reports aggregate publicly available government data including census records, school statistics, crime data, environmental data, and market information.

ValiFit does not provide real estate brokerage services, appraisals, or legal advice. Our scores and reports are informational tools only and should not be the sole basis for any real estate decision.

3. Accounts

You may create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.

4. Subscriptions and Payments

Some features require a paid subscription. Pricing is listed on our Pricing page. Subscriptions auto-renew unless canceled before the renewal date. Payments are processed securely by Stripe. Refund requests may be submitted within 7 days of initial purchase by contacting [email protected].

5. Agent Services

Real estate agents who use ValiFit agree to: (a) maintain valid professional licensing, (b) respond to leads in a timely manner, (c) comply with all applicable real estate laws and Fair Housing regulations, and (d) not misrepresent their qualifications or services. We reserve the right to suspend or terminate agent accounts for violations.

6. Data Accuracy Disclaimer

ValiFit aggregates data from government sources including the U.S. Census Bureau, FBI UCR, NCES, FEMA, EPA, and others. While we strive for accuracy, we do not guarantee that all data is current, complete, or error-free. Property values, tax rates, school boundaries, and other data may change. Always verify critical information independently.

ValiFit scores are not appraisals. Our scoring methodology measures infrastructure investment and publicly available metrics. Scores should not be interpreted as property valuations or guarantees of any kind.

7. Fair Housing

ValiFit is committed to compliance with the Fair Housing Act. Our scores measure infrastructure investment (school funding per pupil, emergency service staffing, environmental safety) — not demographics, race, religion, or national origin. All users and agents must comply with Fair Housing laws when using our platform.

8. Acceptable Use

You agree not to: (a) scrape, copy, or redistribute our reports or data, (b) use the Service for discriminatory purposes, (c) reverse-engineer our scoring algorithms, (d) interfere with the Service's operation, or (e) impersonate another person or entity. Violation may result in immediate termination.

9. Intellectual Property

The ValiFit platform, brand, scoring methodology, and original content are our intellectual property. You may share individual reports for personal, non-commercial purposes. Underlying government data remains in the public domain.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALIFIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSSES FROM REAL ESTATE DECISIONS MADE BASED ON OUR REPORTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.

11. Termination

We may suspend or terminate your access for violation of these terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New Castle County, Delaware.
